These Terms of Service (“Terms”) govern your access to and use of the Kountry Global website, online store, products, services, and related communications (collectively, the “Services”).

The Services are operated by Kountry Global LLC (“Kountry Global,” “we,” “us,” or “our”). By accessing or using the Services, creating an account, submitting information, or placing an order, you agree to these Terms, along with our Return and Refund Policy, Privacy Policy, Shipping Policy, and any other terms presented to you before purchase.

If you do not agree to these Terms, do not use the Services or place an order.

Eligibility

You must be legally capable of entering into a binding agreement to use the Services or place an order.

If you are under the age of legal majority in your jurisdiction, you may use the Services only with the authorization and supervision of a parent or legal guardian.

You agree to provide accurate, complete, and current billing, shipping, payment, account, and contact information.

Electronic Communications

By using the Services or placing an order, you consent to receive transactional communications electronically, including order confirmations, payment receipts, shipping and delivery updates, customer support communications, fraud-prevention or verification requests, and policy and legal notices.

Electronic records, acknowledgments, and signatures may satisfy legal writing and signature requirements to the fullest extent permitted by law.

Consent to receive transactional communications does not constitute consent to receive marketing emails or text messages. Marketing communications are governed by the consent presented when you subscribe, and you may unsubscribe as described in those communications.

Accounts & Security

If account functionality is available, you are responsible for maintaining the confidentiality of your login credentials, restricting access to your account and devices, providing accurate account information, and promptly notifying Kountry Global of suspected unauthorized activity.

You are responsible for activity conducted through your account to the extent permitted by law. Kountry Global may suspend or restrict an account when we reasonably believe it has been compromised or used fraudulently.

Products & Product Information

Kountry Global makes reasonable efforts to display product descriptions, colors, materials, dimensions, sizing, photographs, and other information accurately.

Minor variations in color, texture, stitching, packaging, fit, sizing, or appearance may occur due to screen settings, lighting, production tolerances, manufacturing processes, product updates, and ecommerce fulfillment. These minor variations are not considered defects.

Nothing in this section limits rights relating to products that are materially defective, unsafe, counterfeit, or materially different from their description.

All products are subject to availability. Kountry Global may modify or discontinue products and limit quantities where reasonably necessary.

Orders & Acceptance

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not necessarily constitute acceptance.

An order is accepted when Kountry Global confirms fulfillment or shipment, unless applicable law provides otherwise.

Kountry Global may review, hold, decline, or cancel an order for legitimate reasons, including product or inventory unavailability; pricing or listing errors; fulfillment restrictions or operational constraints; payment authorization failure; suspected fraud or unauthorized payment activity; elevated risk indicators; inaccurate, incomplete, inconsistent, or unverifiable information; purchase, return, refund, or promotional abuse; legal, regulatory, sanctions, security, or compliance requirements; or shipping restrictions.

If Kountry Global cancels an order after payment has been captured, a refund will be issued to the original payment method.

Order Changes & Cancellations

Because orders may enter production or fulfillment shortly after submission, order changes and cancellations are not guaranteed.

To request a change or cancellation, contact support@kountryglobal.com as soon as possible. Any request remains subject to order status, fulfillment limitations, our Return & Refund Policy, and applicable law.

If Kountry Global cancels an order before fulfillment, a refund will be issued to the original payment method.

Prices, Promotions & Errors

Prices are displayed in the currency indicated on the website or at checkout. Currency conversions displayed by third parties may be estimates and may differ from the amount charged by your financial institution.

Kountry Global may change prices or promotions at any time before an order is accepted.

Promotions apply only during the stated promotional period, may be subject to eligibility, product, geographic, or quantity limitations, cannot be combined unless expressly stated, and may be modified or canceled in cases of error, fraud, misuse, or abuse.

If a material pricing, product, or promotional error affects an order, Kountry Global may contact you for instructions or cancel and refund the affected order.

Taxes, Duties & International Charges

Applicable taxes may be calculated and collected at checkout where required.

For international orders, the recipient may be responsible for VAT, customs duties, tariffs, brokerage fees, import charges, or other governmental assessments unless checkout expressly states that such charges are included.

Customs authorities may delay, inspect, reject, or assess charges on a shipment. These actions are outside Kountry Global’s reasonable control.

Orders refused by the customer, returned due to inaccurate shipping information, or deemed undeliverable by the carrier may experience delayed refund processing. Where permitted by law, Kountry Global may deduct actual unrecoverable carrier, customs, or return costs caused by refused delivery, invalid address information, unpaid import charges, or customer-caused delivery failure. Any deduction will be limited to actual unrecoverable costs incurred by Kountry Global.

Payments

Payments may be processed by Shopify Payments, Stripe, PayPal, Shop Pay, card networks, financial institutions, or other supported third-party payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method, the information provided is accurate and complete, and you authorize the applicable product charges, taxes, shipping costs, and disclosed fees.

Payment services are also subject to the applicable provider’s terms and privacy practices. Kountry Global does not guarantee that any particular payment method will remain available.

Order Review & Fraud Prevention

Kountry Global may review orders for fraud prevention, payment security, fulfillment accuracy, legal compliance, and customer protection.

Review procedures may consider information associated with the transaction, including billing and shipping information; payment authorization and verification results; order and account history; device, browser, network, or approximate location signals; transaction patterns and risk indicators; and information supplied by payment and fraud-prevention providers.

Kountry Global may request additional information reasonably necessary to verify identity, payment authorization, shipping information, or order legitimacy.

Orders may be delayed, canceled, refunded, declined, or denied fulfillment if they present elevated risk indicators, including suspected fraud, unauthorized payment activity, mismatched information, payment verification failure, or compliance concerns.

For select orders, Kountry Global may require additional verification, signature confirmation, enhanced shipment protection, or manual review before fulfillment.

Our collection and use of personal information are described in our Privacy Policy.

Shipping, Delivery & Fulfillment

Shipping methods, processing times, and estimated delivery windows are described at checkout or in our Shipping Policy. Delivery dates are estimates unless expressly stated otherwise.

Kountry Global is not responsible for delays caused by customs, carriers, severe weather, labor interruptions, governmental actions, transportation disruptions, supply shortages, inaccurate customer information, or other circumstances outside our reasonable control.

If Kountry Global cannot ship within the represented timeframe, we will provide any notice, cancellation option, or refund required by applicable law.

Kountry Global may require tracking, delivery confirmation, signature confirmation, enhanced shipment protection, or other reasonable fulfillment measures based on order value, destination, product type, or transaction risk.

Customers are responsible for providing complete and accurate shipping information, including apartment, suite, building, access, and delivery details. Address changes are not guaranteed after an order is submitted.

Delivery is considered complete when the shipping carrier confirms delivery to the address provided at checkout. Confirmation may include tracking scans, delivery records, signature confirmation, geolocation confirmation, or equivalent carrier evidence.

Kountry Global is not responsible for non-delivery or delivery issues caused by incorrect, incomplete, or inaccessible shipping information provided by the customer.

Lost, Stolen, or Missing Packages After Delivery

For packages marked delivered by the carrier, claims involving loss, theft, porch theft, or non-receipt after confirmed delivery must be submitted to the carrier.

Kountry Global may assist with carrier documentation where appropriate, but we are not responsible for loss, theft, or damage occurring after confirmed delivery, except where otherwise required by law.

Returns, Exchanges & Refunds

Kountry Global’s Return and Refund Policy is incorporated into and made part of these Terms.

Kountry Global accepts eligible returns requested within 30 calendar days of confirmed delivery. Approved returns receive free return shipping and must follow the return instructions provided by Kountry Global.

To start a return, contact returns@kountryglobal.com with your order number and the reason for your request. Returns sent without prior approval may be rejected, delayed, returned to sender, or deemed ineligible for refund.

Approved refunds are issued to the original payment method and are generally processed within 7 to 10 business days after the returned item is received, inspected, and approved. Kountry Global does not charge restocking fees.

Exchanges are processed as a return plus a new order and remain subject to return eligibility, inspection, product availability, pricing, taxes, shipping timelines, and promotional limitations.

Nothing in these Terms limits mandatory rights relating to defective, unsafe, misdescribed, or nonconforming products.

Damaged, Defective, Incorrect, or Missing Items

If an order arrives damaged, defective, incorrect, or materially incomplete, contact returns@kountryglobal.com within 7 calendar days of confirmed delivery.

Please include your order number, photos of the item, photos of the packaging and shipping label, photos showing the issue clearly, and any other relevant delivery or product details.

After review, Kountry Global may provide a replacement, refund, store credit, or another appropriate resolution depending on the issue, product availability, shipment details, and review outcome.

International Consumer Rights

Customers may have mandatory rights under the laws of their country or region. Nothing in these Terms excludes or restricts rights that cannot legally be excluded or restricted.

If these Terms conflict with a mandatory consumer-protection law applicable to a customer, the mandatory law will control to the extent of the conflict.

EU & UK Withdrawal Rights

Eligible consumers in the European Union and United Kingdom may have the right to cancel qualifying online purchases within 14 days after receiving the goods, without providing a reason.

After notifying Kountry Global of the cancellation, the customer must return the goods within the legally applicable period. Refund timing, standard-delivery costs, return costs, permissible deductions, and exceptions will be handled in accordance with applicable law and our Return and Refund Policy.

Exceptions may apply to certain products, including goods made to a customer’s specifications, clearly personalized goods, or sealed goods that are not suitable for return for health or hygiene reasons after being unsealed.

Ordinary fulfillment or shipment of physical goods does not, by itself, eliminate an applicable statutory withdrawal right.

Payment Disputes

If there is an issue with your order, please contact support@kountryglobal.com before initiating a payment dispute or chargeback. Kountry Global is committed to resolving concerns fairly and professionally.

Nothing in these Terms prevents a customer from exercising legitimate rights through a payment provider, card issuer, or applicable law.

If a payment dispute is opened, Kountry Global may provide order records, checkout records, delivery confirmation, customer communications, return and refund records, fraud review information, and other relevant documentation to the payment processor, bank, card issuer, or dispute platform.

Abusive, fraudulent, or misleading dispute activity may result in loss of return privileges, account limitations, or refusal of future service where permitted by law.

Acceptable Use

You may not use the Services to violate any law or third-party right; commit fraud or submit false or misleading information; introduce malicious code or interfere with website security or operation; scrape, harvest, or collect information without authorization; impersonate another person or organization; circumvent purchase, product, geographic, account, or security restrictions; abuse promotions, returns, refunds, payment disputes, or customer support; infringe intellectual property or privacy rights; or use automated purchasing systems without authorization.

Kountry Global may suspend or terminate access where we reasonably believe these restrictions have been violated.

Resale

Unless expressly authorized, products are sold for personal use and legitimate gifting.

Kountry Global may limit quantities or refuse orders that reasonably appear intended for unauthorized commercial resale, diversion, fraudulent activity, or promotional abuse.

This section does not prohibit lawful resale rights that cannot be restricted under applicable law.

Intellectual Property

The Services and their content, including Kountry Global’s name, trademarks, logos, designs, photographs, graphics, videos, text, product designs, website layout, and other materials, are owned by or licensed to Kountry Global and are protected by applicable intellectual property laws.

You may access the Services for personal, noncommercial shopping purposes.

Without prior written permission, you may not reproduce, modify, distribute, publish, sell, license, create derivative works from, or commercially exploit protected Kountry Global content.

No license to Kountry Global’s trademarks or other intellectual property is granted except as expressly stated.

User Content & Feedback

If you submit reviews, photographs, comments, feedback, suggestions, or other content, you represent that you own or control the necessary rights; the content is accurate to the best of your knowledge; the content does not violate any law or third-party right; and the content is not fraudulent, defamatory, abusive, unlawful, or misleading.

You grant Kountry Global a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute submitted content for operating, improving, and promoting the business, subject to applicable law and our Privacy Policy.

Kountry Global is not obligated to publish or retain submitted content.

Third-Party Services & Links

The Kountry Global store may be hosted by Shopify and may integrate services provided by payment processors, fulfillment providers, carriers, analytics providers, social platforms, and other third parties.

Third-party services are governed by their own terms and privacy policies. Kountry Global is not responsible for third-party websites, content, availability, or conduct except to the extent required by law.

Links to third-party resources do not necessarily constitute endorsement.

Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available.”

Kountry Global does not guarantee that the website will always be uninterrupted, secure, accurate, or error-free.

Any implied warranties are excluded only to the extent legally permitted. This disclaimer does not limit mandatory warranties, product guarantees, or consumer rights that cannot legally be waived.

Limitation of Liability

To the fullest extent permitted by law, Kountry Global and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services or a purchase.

Where legally permitted, Kountry Global’s aggregate liability for a claim relating to a particular order will not exceed the amount paid for that order.

These limitations do not apply where liability cannot legally be limited, including where applicable for fraud, willful misconduct, gross negligence, personal injury, death, or mandatory consumer-protection obligations.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to every customer.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Kountry Global harmless from third-party claims, losses, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.

This obligation does not apply to claims caused by Kountry Global’s own unlawful conduct, negligence, or breach of duty.

Force Majeure

Kountry Global will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, epidemics, war, civil unrest, labor disruptions, governmental actions, customs delays, transportation interruptions, cyberattacks, internet outages, supply shortages, or carrier failures.

This section does not eliminate any cancellation, notice, refund, or other mandatory right provided by applicable law.

Dispute Resolution & Governing Law

Before filing a legal claim, each party agrees to make a good-faith effort to resolve the dispute informally. Customers may initiate this process by contacting support@kountryglobal.com with a description of the issue and requested resolution.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Subject to applicable consumer-protection law, legal proceedings relating to these Terms or the Services must be brought in a court of competent jurisdiction located in Nevada.

Nothing in this section prevents an eligible claim from being filed in small claims court or limits a consumer’s right to rely on mandatory laws or courts available in the consumer’s place of residence.

Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will remain in effect.

No Waiver

Failure by Kountry Global to enforce a provision of these Terms does not waive the right to enforce it later.

Any waiver must be explicit and in writing.

Assignment

You may not assign your rights or obligations under these Terms without Kountry Global’s written consent.

Kountry Global may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or other lawful business transfer, subject to applicable law.

Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement regarding your use of the Services and purchases from Kountry Global, except for any additional terms expressly accepted for a particular product or service.

Changes to These Terms

Kountry Global may update these Terms from time to time to maintain operational accuracy, legal compliance, payment processor compliance, fraud-prevention standards, and customer experience quality.

Revised Terms become effective when published unless otherwise stated. Changes will not retroactively alter the terms governing an order already accepted unless required by law or expressly agreed.

The “Last updated” date identifies the latest revision.
